Eric Gibbs to Provide Plaintiff’s Perspective at ACI Class Action Seminar in New York

On Monday, April 11, 2016, Eric Gibbs will participate in American Conference Institute (ACI)’s “Defending and Managing Class Actions” Seminar in New York. Together with prominent attorneys from both the plaintiff and defense bars, Mr. Gibbs will participate in the panel discussion addressing best practices in class action settlements. Specifically, the panel will cover:
- Factors to consider when determining whether to settle a lawsuit;
- Calculating attorneys’ fees in the wake of a settlement;
- Key elements of settlement agreement submissions to drive preliminary approval;
- Navigating the labyrinth of class notice programs;
- Addressing settlement objectors.
Gibbs’ Experience in Class Action Settlement Negotiations
In his twenty years of practice, Eric Gibbs has successfully prosecuted more than 100 class action and complex matters, serving in court-appointed leadership positions in a diverse array of cases addressing consumer fraud, automobile defects, data breach and privacy, truth-in-lending, product liability, and employment matters.
He has achieved some of the largest and most impactful consumer settlements of all time, including a $100 million recovery for borrowers In re: Chase Bank U.S.A., N.A. “Check Loan” Contract Litigation, concerning unexpected loan modifications; and settlements of $800 each for owners of up to 35 million General Motors vehicles In re: General Motors Corp. Dex-Cool Products Liability Litigation, concerning allegedly defective engine coolant. Eric also served as lead counsel in In re: Adobe Systems, Inc. Privacy Litigation, secured a landmark ruling making it easier for plaintiffs to seek relief following a data breach.
He has successfully prosecuted cases against some of the largest corporations in the country, including Intel, Apple, Health Net, Blue Shield, DISH Network, AmeriGas, Bayer Healthcare Pharmaceuticals, Honda, Chrysler, Mitsubishi, Mercedes-Benz, BMW, Ducati, Toyota, Hyundai, Kia, and Whirlpool.
Eric frequently presents on trends and innovative approaches in consumer class actions for leading consumer and legal industry organizations, including American Association for Justice, Consumer Attorneys of California, Bridgeport Continuing Legal Education, the San Francisco Bar Association, HarrisMartin Publishing, Law Seminars International, and HB Litigation.
