
David Berger Appointed to Leadership in Tempus AI Data Privacy Lawsuit

David Berger, partner at Gibbs Mura, has been appointed to case leadership on the Plaintiffs’ Executive Committee in the Tempus AI (Ambry Genetics) Data Privacy Lawsuit. David was nominated to this position by Interim Co-Lead Class Counsel and affirmed and appointed by the federal court on May 6, 2026. In a competitive process where multiple attorneys applied for leadership, this means a judge and peers have trusted David Berger to help lead the case for all potentially affected patients around the country.
The class action lawsuit alleges that Ambry Genetics, a subsidiary of Tempus AI, improperly used patients’ genetic information to train AI models without their knowledge or consent.
